Informed consent (according to art. 13 and 23 of Lgs. D. 196 of 30 June 2003)

 

Legislative Decree no. 196 of 30/06/2003 provides for the protection of individuals and other persons in respect of personal data processing.
In accordance with the law, the treatment to which your personal data will be subject is possible only with your consent and after providing appropriate information based on the contents stipulated in article 13. In accordance with the aforesaid law, the processing in question is expected to be correct, lawful and transparent, safeguaring your confidentiality and your rights.
The expected processing:
• has the following purposes: – civil law/accounting/fiscal obligations – credit management – sending of advertising materials;
• Moreover we may decide to process your personal data in pursuance of legal obligations, regulations and/or Community provisions, or if required by authorities and supervision and/or inspection authorities;
• with regard to the aforesaid purposes, the data processing methods shall include the following: recording, filing and storage as computer file and/or hard copy.
• you are free to agree to the transfer of personal data, although this in some cases is necessary in order to uphold specific obligations;
• any refusal to respond from your part will make it impossible for us to fulfill contractual duties
• the data may/shall be transferred to: – local government offices – public non-profit organisations – state-controlled companies – banks and credit institutes – business or trade associations – consulting and data processing firms – business or trade enterprises.
• the data controller is: C&S Srl represented by its owner/attorney;
• no data processor has been appointed as yet.
You may refer to the said data controller in order to protect your rights, in accordance with art. 7 of Legislative Decree 196 of 30/06/03 which, for your convenience, are listed here below:
the right to agree to the treatment, although with some derogations regarding cases where, by law, data processing does not require any consent;
the right to access, free of charge, the public registry created by the Authority pursuant to art. 154 of Legislative Decree 196 of 30/06/03;
the right to be informed about the data controller’s identification details, as well as the methods and purposes used for processing;
the right to act with regard to your personal data;
the right to claim damages in case of illegitimate processing;
the right to object, totally or in part, to the personal data processing intended for business information purposes, the sending of advertising materials, direct selling, market research of interactive business communication;
the right to be informed by the data controller, no later than the data on which the data are transferred or divulges, about the possibility of exercising such right free of charge;
the right to object to any behavioural assessment based solely on automated processing aimed at profiling or describing the personality of the person concerned.This information is provided for the collection of data both from the person concerned and from third parties.
